Terms of sale

Last updated: 15 October 2026. The French text is the reference version. Translations are not a certified legal version.

1. Who provides the services

Group catering and water-sports services are provided by SKI & WAKE 74, a single-shareholder simplified joint-stock company (SASU), registered office 802 Route de Marceau Dessous, 74210 Doussard. The trading name is SkiWake 74. Guests are welcomed and the services are carried out at 120 Route de la Plage, 74210 Doussard, Lac d'Annecy.

They cover, in particular, breakfasts, drinks receptions, fire-pit meals, buffets and similar services, as well as water skiing, wakeboarding, wakesurfing, boat outings and related water activities. The accepted quote states which service is concerned.

The website can be used to request a quote. Sending the form does not book a date and does not take any payment.

2. Quote, deposit and booking

The quote states the nature of the services, the expected number of participants, the date, the times, the place and the prices.

The booking becomes final when a deposit of 50% of the total amount of the quote, including tax, is received. This deposit is a firm commitment by the client and is deducted from the price. It is not arrhes under French law: neither party may withdraw by forfeiting that sum or by paying double that sum.

If SkiWake 74 cancels the service, the deposit and any balance already paid follow article 6: they are not kept if the client accepts neither a new date nor a credit.

3. Number of participants

The final number is given at the latest seven days before the service. An increase depends on service capacity and may be charged in addition.

For water-sports services, the number of participants also depends on capacity, safety and the rules that apply to the boats and the activities.

4. Cancellation of catering

Any change or cancellation requested by the client is made in writing. The steps below do not apply when SkiWake 74 cancels the service: article 6 then applies.

  • More than fifteen days before: the deposit may be refunded in a case of duly evidenced force majeure, after deduction of costs already incurred.
  • Between fifteen and seven days before: the deposit is kept, unless the provider expressly agrees otherwise or there is duly evidenced force majeure.
  • Less than seven days before: the deposit is kept, unless the provider expressly agrees otherwise or there is duly evidenced force majeure.

These rules may be adapted to the service and to purchases already made for the order. The particular conditions of the quote then say so. No file-handling fee is charged.

5. Cancellation of a water-sports service

These rules concern a cancellation requested by the client. The 50% deposit makes the booking firm. It reflects the reservation of equipment, gear, staff and the means required. If SkiWake 74 cancels, article 6 applies.

  • Cancellation by the client less than seven days before: the deposit is not refundable, except in a case of duly evidenced force majeure or with the provider’s express agreement.
  • Cancellation by the client seven days or more before: a refund or a postponement may be considered according to costs already incurred and the possibility of postponing. It is not an automatic refund.

6. Cancellation by SkiWake 74

When SkiWake 74 cancels a service, in particular for weather or safety reasons, the client is offered another date or a credit.

If no new date is suitable and the client does not want a credit, the sums already paid for the cancelled service are refunded in full. A credit cannot be imposed instead of that refund. No cancellation fee is kept.

This rule does not apply to cancellations requested by the client, which remain those in articles 4 and 5. It prevails over any other sentence in these terms that would allow the deposit, the balance or fees to be kept in this case.

SkiWake 74 decides whether the weather or navigation conditions allow the activity. Rain, on its own, is not an automatic ground for cancellation.

The full refund is due within the period required by law for the return of sums paid for a service that was not performed. No contractual period is added.

7. Prices and payment

The prices in the quote are in euros, including all taxes. No starting price is displayed on the website. A service that is not in the quote is charged only after the client agrees.

Payment is 50% including tax on ordering, as a deposit, then 50% before the service, as stated in the quote. The deposit is required for the booking to be confirmed.

Between professionals, late payment may give rise to the penalties provided by law. No additional rate is added here for a consumer.

8. Times, safety, allergies and equipment

The agreed times are observed. A significant delay does not extend the service, unless both parties agree. An extension may lead to costs related to staff, equipment or gear, agreed before it starts.

Safety instructions, equipment and boats are to be respected. The provider may refuse participation when behaviour, alcohol or an inability to follow the instructions compromises safety.

Allergies and diets are notified at the latest seven days before. What can be done depends on the information received. A total absence of allergen traces is not guaranteed.

Damage to equipment, boats or premises caused by inappropriate use or by a fault of the client or the client’s guests may be charged. This rule does not limit the provider’s liability for damage caused by its own fault.

9. Force majeure

The provider is not liable for non-performance or delay resulting from an event of force majeure or from a circumstance beyond its control. If that situation leads SkiWake 74 to cancel the service, article 6 applies: a postponement or a credit is offered, and the refund is in full if the client accepts neither. No fee is then kept.

10. Acceptance

Approving the quote amounts to acceptance of these terms. If they conflict, the particular conditions of the quote prevail. A consumer keeps the mandatory protections of the law, including those of the consumer’s country of residence in the European Union. A professional client does not automatically benefit from the same rules.

11. Personal data

The controller is SKI & WAKE 74, David Pons-Ramells, president, registered office 802 Route de Marceau Dessous, 74210 Doussard. Processing on the website is described in the privacy policy. The website does not take payment and does not store card data.

12. Complaints and mediation

A complaint is sent in writing to annecyevg@gmail.com or to SKI & WAKE 74, 120 Route de la Plage, 74210 Doussard, Lac d'Annecy. Useful supporting documents may be attached. No period shorter than the one required by law is imposed for a complaint to be admissible.

No consumer mediator has been appointed yet. As soon as one is, the mediator’s details will be published here and in the legal notice. Referring a matter to that mediator will be free of charge for the consumer, after a written complaint that has not been resolved.

13. Applicable law

French law applies. A consumer residing in the European Union keeps the mandatory protections of the consumer’s country of residence. The competent courts are those designated by law. For the purposes of these terms, the company’s domicile is its registered office.

The terms of use describe the website. They do not replace these terms of sale.
